Making a High Quality Will

It is important to ensure that your estate is distributed one day in accordance with your wishes. The only way to ensure that your estate is distributed to your desired beneficiaries is by making a valid will.

If you do not make a valid will, your estate may be divided and distributed in accordance with South Australian laws. By not making a valid will, it can make it much more difficult for your family to know exactly who is to administer and benefit from your estate. It may mean that your estate is distributed to people not of your choosing or in a way that is not at all suitable.

Our highly experienced Wills & Estates lawyer will take the time needed to plan your estate with the attention to detail which this important process requires.

Enduring Power of Attorney

An enduring power of attorney, or EPOA, is a important and useful legal document that allows you to appoint a person to manage your financial and legal affairs. This document can be relied on if you become unable to make legal decisions for yourself due to illness, injury or other circumstances.

An EPOA is a specific type of power of attorney that continues to be valid even if you lose mental capacity to make decisions for yourself.

What can your Enduring Power of Attorney do?

Your appointed person will have the authority to make decisions and take actions on your behalf, such as managing your bank accounts, paying bills, buying or selling property and making legal decisions to assist you.

It is important to appoint a person who you trust to act in your best interests and who has the skills and knowledge necessary to manage your affairs. We can advise you in relation to your specific circumstances to assist you in choosing the most appropriate person.

Our Process

When making wills and enduring powers of attorney with our firm, we have two appointments:

  • In our first appointment with you, we provide you with personalised legal advice and take your instructions. We then prepare your estate documents and provide you with draft documents to ensure that you are satisfied.

  • In the second appointment, we discuss and sign your estate documents with you. We have flexible meeting options available for our appointments; these include by telephone, zoom, home visit (additional charge may apply) or at our Adelaide office.
